Terms of Service
These Terms of Service ("Terms") govern your use of the SumiQ iOS application ("SumiQ" or the "App"), provided by an independent developer based in Spain ("we", "us"). By downloading, installing, or using SumiQ you agree to these Terms. If you do not agree, do not use the App.
1. The App
SumiQ is a personal finance tracker for iPhone. You can record income and expenses by speaking or typing, organise them into categories and lists, and view simple charts and budgets. The App processes your data on your iPhone and, when iCloud sync is enabled, in your private iCloud container. Voice input is optionally enhanced by an AI service that helps categorise your entries — see our Privacy Policy for the technical details.
2. Eligibility and age
SumiQ is not directed at children. By using the App you represent that you are at least 13 years old, or the minimum age required by the laws of your country, whichever is higher. If you are a minor under the applicable digital- consent age in your jurisdiction (16 in much of the EU, 14 in Spain under LOPDGDD), you must have your parent's or guardian's permission to use the App.
3. Your responsibilities
- Use the App for your own personal, non-commercial finance tracking. You may not use the App for illegal activity, money laundering, tax evasion, or any purpose prohibited by the laws of your country.
- The accuracy of the data you enter into the App is your responsibility. SumiQ does not provide financial, tax, or legal advice and is not a substitute for a qualified professional.
- Keep your iPhone, your Apple ID, and your iCloud account secure. Anyone with access to your unlocked device can see your data.
- Comply with the App Store's Standard End User License Agreement in addition to these Terms.
4. Subscriptions, billing, and free trial
SumiQ requires an active subscription to use after the free-trial period.
- Free trial — first-time subscribers receive a 3-day free trial. The trial converts automatically into a paid subscription at the end of the trial unless you cancel at least 24 hours before the trial ends.
- Plans — Monthly ($3.99/month) and Yearly ($29.99/year), or the local-currency equivalent set by the App Store. Prices may vary by territory.
- Renewal — subscriptions auto-renew at the end of each billing period at the then-current price.
- Cancellation — you can cancel anytime from iOS Settings → [your Apple ID] → Subscriptions → SumiQ. Cancellation takes effect at the end of the current billing period; you keep access until then. No partial refunds for the unused portion of a period.
- Refunds — refunds are handled exclusively by Apple. Request one at reportaproblem.apple.com.
- Price changes — if we change a recurring price, Apple will notify you and ask for explicit consent before the next renewal.
5. Intellectual property
SumiQ, its source code, design, name, logo, and content are owned by the developer and are protected by copyright, trademark, and other intellectual-property laws. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to install and run the App on Apple devices you own or control, solely for personal use, in accordance with Apple's Standard EULA.
The data you create in SumiQ (transactions, categories, etc.) is yours. We claim no rights over it.
6. Acceptable use
You agree NOT to:
- Reverse-engineer, decompile, or attempt to extract the source code of the App or its compiled binaries, except as permitted by mandatory local law.
- Circumvent any rate-limit, abuse-prevention, or subscription-enforcement mechanism in the App or in our AI proxy service.
- Use the AI categorization feature to process content that is unlawful, harmful, harassing, defamatory, or that violates the rights of any third party.
- Use the App in a way that interferes with other users or with the underlying services (App Store, iCloud, OpenAI, Cloudflare).
We reserve the right to suspend AI-categorization access for accounts that abuse the service (for example by exceeding rate limits via automated tooling). Core local functionality of the App is not affected by such suspension.
7. Disclaimer of warranty
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including without limitation any warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that any AI-suggested category, currency, amount, or date will be correct — you remain responsible for reviewing every entry before saving.
Nothing in this section limits any non-waivable rights you have as a consumer under the laws of your country (in Spain, in particular, the Real Decreto Legislativo 1/2007 consumer-protection law).
8. Limitation of liability
To the maximum extent permitted by applicable law, the developer shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of (or inability to use) the App, even if we have been advised of the possibility of such damages.
The developer's aggregate liability for any claim arising out of or relating to these Terms or the App shall not exceed the greater of (a) the amount you have paid to use the App in the 12 months preceding the event giving rise to the claim, or (b) ten euros (€10).
Nothing in this section excludes or limits liability that cannot be excluded or limited under applicable law, including liability for gross negligence, fraud, death, or personal injury caused by the developer's wilful misconduct.
9. Third-party services
SumiQ depends on several third-party services that are governed by their own terms:
- Apple (App Store, iCloud, StoreKit) — Standard EULA and the App Store Terms of Service.
- RevenueCat (subscription management) — revenuecat.com/terms.
- Cloudflare (AI request proxy) — cloudflare.com/website-terms.
- OpenAI (AI categorization) — openai.com/policies/terms-of-use.
We are not responsible for the policies, availability, or actions of these providers. Outages or changes on their side may affect AI categorization or subscription management.
10. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top of this page, and material changes will also be surfaced through an in-app notice on the next app launch. Continued use of the App after a change constitutes acceptance of the revised Terms. If you do not agree, stop using the App and cancel any active subscription via the App Store.
11. Termination
You may stop using the App at any time by deleting it from your iPhone and cancelling any active subscription via the App Store. We may suspend or terminate your access to the AI categorization service if you breach these Terms (for example by abusing rate limits or attempting to reverse-engineer the proxy). On termination, the licence in Section 5 ends but the data on your iPhone / in your iCloud remains yours.
12. Governing law and jurisdiction
These Terms are governed by the laws of the Kingdom of Spain. Any dispute arising out of or relating to these Terms or to your use of the App shall be subject to the exclusive jurisdiction of the courts of Barcelona, Spain, without prejudice to consumer-protection rules that grant a consumer domiciled in the European Union the right to litigate in their own country of residence.

13. Entire agreement and severability
These Terms, together with the Privacy Policy and Apple's Standard EULA, constitute the entire agreement between you and the developer concerning the App, and supersede any prior agreements on the same subject. If any provision of these Terms is found unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full effect.
